Lawyer For Apple: 'What In The Law Requires Us To Redesign The iPhone?'

Frazer Harrison/Getty Images Now he's representing Apple in the company's battle with the FBI, which has asked the tech giant to help federal investigators circumvent some of the security features in an iPhone 5C that was used by one of the San Bernardino shooters.
In an interview with NPR's Steve Inskeep on Morning Edition, Olson said the iPhone was expressly designed to prevent the sort of thing the government is asking for.
"What in the law requires us to redesign the iPhone, to rewrite code, to provide an Achilles' heel in the iPhone?" Olson said. "It was designed to protect the secrecy and privacy of individuals who use the iPhone."
He argues that while Apple is obligated to assist in federal investigations, there is a limit to what the government can require it to do:
"A landlord is required to unlock a door. But a landlord isn't required to build a door or to build a key or to build a lock.
"What the government is asking Apple to do here is to redesign this particular iPhone, to take weeks of its engineers to put together a system to disable the systems that Apple put into the system in the first place. ... They want various features to be changed so you could get around the passcode."
The FBI is specifically asking Apple to write software that investigators could load on this phone that would allow them to try out many possible passcodes. Currently, if they try to guess the phone's PIN, they risk triggering an auto-delete feature that would destroy the phone's data. There's also a mandatory delay between entering incorrect passcodes, and they must each be entered manually.
The government says such a piece of software would be written specifically for the San Bernardino shooter's iPhone and wouldn't be usable on any other device. But Apple has repeatedly argued that the software, once created, would be too easy to reuse and would be requested again and again by investigators and prosecutors.

"The district attorney of Manhattan said, 'I have 175 cell phones, I need to use this same technique to get into those phones' — and not just terrorism cases," Olson said.
And it opens the door to future requests, he said: "There's really no limitation if the federal government, through a judge's order, can ask you to redesign your own products."
Olson said Apple has cooperated "in every way in every federal or state criminal investigation, up to the point that the law permits it" — but that writing software for the iPhone to make it less secure crosses the line
He called it "unfortunate" that Republican presidential candidate Marco Rubio said Apple was taking this stance to protect its brand. "What Apple is attempting to do is to protect the integrity of the product that hundreds of millions of people depend upon," Olson said.
Olson's wife died in the Sept. 11, 2001, terrorist attacks, and Inskeep asked if — given his personal history — Olson found it difficult to dismiss arguments from federal investigators that accessing this particular iPhone could help them prevent future terrorist attacks.
"We care very, very much, and I do personally, about any instance of terrorism or an effort to prevent it or redress it," Olson said. "But we have to balance our constitutional rights and make sure that we protect what America is all about. So we can't cross the line of giving up protections that are built into our Constitution — terrorists want to tear that down. We can't give in to that."

On December 15, 2015, the Copyright Royalty Board issued its decision establishing non-interactive webcasting royalty rates for sound recordings in the 2016-2020 period. These rates represent a partial increase over the amount currently paid by digital radio services transmitting music via the Internet.
Future of Music Coalition CEO Casey Rae made the following statement:
These rates aren't exactly a lump of coal. Over the past decade, we've seen billions of dollars in revenue generated by the explosive growth in webcasting. The new rates will allow artists and independent labels to participate in this success at a higher level. The fundamental value of popular Internet radio services comes from music creators, and we are glad this has been recognized in a healthy rate increase for non-subscription Internet radio services. Creators can feel good about how payout is structured under the statutory license, where revenue splits between artists and labels are fair and transparent, and payment to artists comes direct from SoundExchange.
We are concerned, however, that there does not appear to be a distinction in rates for small commercial webcasters. Digital music benefits from diversity, and services with more modest operations often help developing talent and niche genres find audiences while contributing to the overall revenue pool. If there isn't an option for new entrants to perform music from a broad range of artists, we may end up with a less diverse digital landscape.
It also appears that by combining pureplay and commercial rates, incumbent broadcasters will receive a sizable reduction in royalty obligations for their digital transmissions. Commercial terrestrial radio already gets an unfair advantage due to the fact that they are not required to pay performers a dime for over-the-air broadcasts. This is in stark contrast to the rest of the developed world. Congress should take swift action to close this loophole to support a positive global balance of trade and the equitable treatment of American creators. And artists and their allies should push back on consolidated corporate FM getting yet another unfair advantage.

Debby Clinton's Platinum Sound Records of Mountain Park, Oklahoma rocks the music charts
Clinton is also an actress that has appeared in many films including with Hong Kong's Bruce Li, Chuck Norris, and several others. But her love of the recording business really took her by storm. It has always been her first love and when she first met RG Ingersoll, who introduced her to Lee Rogers and Kenny Smith, and that's what we call it history. Clinton actually took control of Platinum Sound back in 2004, ask the SDC OmniMedia Group would periodically release several compilation CDs from various artists on the label over the years.
Clinton is behind the RG's All Nite Funk Band with three major charting songs in the pass two years, and with two artists riding the national charts as this story is being put together.
It would only be three (3) years later that Sir Paul McCartney of MPL Communications would purchase all of Claridge Records. Along with the Platinum Sound Records, all of the masters of the Four Seasons, Mitch Ryder, Bo Kirkland, Ruth Davis, Freddie Canon, Sugarloaf and Cardella DiMilo.
McCartney's streamlining of Claridge Records and its publishing arm all went into the catalog of Wen Music. As Platinum Sound was only an independent production house, Lee Rogers our CEO/President at that time decided it would be a better deal if we went on our own.
Platinum Sound Records was born with the release of Lee Rogers' "Second Thoughts" produced by RG Ingersoll for his Hotrax Productions.
Clinton has been active in the music business for over twenty-five years and this quiet beautiful lady does not even let her neighbors know anything about her music and/or business attributes.
Burning the midnight oil, you would fine Clinton up at all hours of the night working on websites, group and record productions and promotions. Yet a grandmother, she always find some time to be with her children and grand children. But grandma rocks.
It was with little hesitation that Smith decided to record Clinton's first release for the Mountain Park, Oklahoma, with the hot label and moving it from Memphis, Tennessee. Clinton is the co-writer on several of the new songs along with Ingersoll and including a rendition of her first single 'Love Confusion". The album/CD is entitled "Brain Freeze: The Memphis Sessions" by Kenny Smith with Clinton as the executive producer. The CD will be released by January 2016 for Platinum Sound Records.
